Who is responsible for processing your personal data?

ESPAI INFORMATIC MULTISECTORIAL SL is the CONTROLLER responsible for processing the USER’s personal data and informs you that such data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD).

What do we process your personal data for?

To maintain a commercial relationship with the user. The processing operations envisaged are:

  • Sending advertising commercial communications by email, fax, SMS, MMS, social media or any other electronic or physical means, present or future, that makes it possible to send commercial communications. These communications will be made by the CONTROLLER and will be related to its products and services, or those of its partners or suppliers, with whom it has reached a promotional agreement. In this case, third parties will never have access to personal data.
  • Conducting market research and statistical analyses.
  • Processing assignments, requests, responding to enquiries or any type of request made by the USER through any of the contact methods made available on the CONTROLLER’s website.
  • Sending the online newsletter concerning news, offers and promotions related to our activities.

Why can we process your personal data?

Because the processing is legitimised under Article 6 of the GDPR as follows:

  • With the USER’s consent: sending commercial communications and the newsletter.
  • On the basis of the CONTROLLER’s legitimate interest: conducting market research, statistical analyses, etc., and processing assignments, requests, etc. at the USER’s request.

How long will we keep your personal data?

They will be retained for no longer than is necessary to fulfil the purpose of the processing or for as long as legal requirements require their retention, and when they are no longer necessary for that purpose, they will be deleted with appropriate security measures to ensure the anonymisation or complete destruction of the data.

Who do we disclose your personal data to?

For the proper provision of the services offered, the user’s personal data may be disclosed to the company SERVEIS INTEGRALS GARROTXA S.L. (CREDITECH) CIF B55343271 Carrer Bisbe Vilanova, 21, Bajos 1r, 17800, Olot (Girona), whose involvement is necessary for the performance of the contracted service. Such disclosure will be made exclusively for the purpose of managing, developing and delivering the services requested by the user.

The recipient company will process the data in accordance with the applicable data protection regulations and the required security and confidentiality measures, and may not use it for its own purposes other than those related to the provision of the service, except where legally required.

The legal basis legitimising this disclosure is the performance of the contractual relationship or the application of pre-contractual measures requested by the data subject, in accordance with Article 6(1)(b) of Regulation (EU) 2016/679 (GDPR).

What are your rights?

The USER has the following rights:

  • The right to withdraw consent at any time.
  • The right to access, rectify, transfer and erase their data, and to restrict or object to its processing.
  • The right to lodge a complaint with the supervisory authority (www.aepd.es) if you consider that the processing does not comply with the applicable regulations.

In accordance with the provisions of the current personal data protection regulations, the CONTROLLER complies with all provisions of the GDPR and LOPDGDD regulations for the processing of personal data under its responsibility, and in particular with the principles described in Article 5 of the GDPR, pursuant to which data is processed lawfully, fairly and transparently in relation to the data subject and is adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed.
